Cancel the Noise Giveaway Terms and Conditions

These Terms and Conditions ("Terms") govern the marketing promotional campaign ("Campaign") organized by Avex Designs LLC, 169 Madison Ave., Ste. 11339, New York City, New York 10016, United States ("Avex Designs").

1. Eligibility The participation in the Campaign is open to individuals that meet all of the following criteria:

  • Operate on a homegrown e-commerce platform. 

  • Are not technology or agency partners of Avex. 

  • Have a clear intent to replatform the company’s digital infrastructure.

  • Have completed a consultation call with the Avex Designs team.

  • Operate in regions where Avex Designs’ eCommerce services are available.

Eligible participants must be representatives of qualifying companies and have reached the age of majority in their place of residence at the time of entry.

2. Campaign Entry To participate in the Campaign, participants must complete the entry form on the Campaign’s website and provide all required information, including their business email address.

3. Campaign Period The Campaign begins on September 2, 2025, and ends on December 31, 2025, or when the inventory of gifts runs out, whichever occurs first. Avex Designs reserves the right to adjust the Campaign period based on the results of the campaign.

4. Evaluation and Selection of Awardees Awardees will be selected by Avex Designs from individuals who have completed a qualified consultation and demonstrated clear intent to replatform their eCommerce or digital infrastructure. Selection will be based on Avex Designs’ assessment of the participant’s eligibility and alignment with the Campaign criteria. The current intention is to have10 awardees, with the possibility of changing the number of awardees at Avex Designs' sole discretion.

5. Gifts The gift consists of a pair of custom Apple AirPods Max headphones. Apple is not a participant in or sponsor of this Campaign. The gift is non-transferable and cannot be exchanged for cash or other alternatives. The gift will be delivered to any location where Avex Designs' delivery service operates, subject to country-specific restrictions.

6. Notification and Acceptance Awardees will be notified by email and asked to provide their delivery address. Awardees must respond within 14 business days of receiving the notification email. If an awardee does not respond within this timeframe, Avex Designs may, at its discretion, either select an alternative awardee or cancel the gift.

7. Legal Disclosures No purchase or payment is necessary to participate in this Campaign. The provision of feedback does not guarantee receipt of a gift. Awardees are responsible for any potential tax implications associated with receiving the gift. Avex Designs is not liable for any damages or losses resulting from participation in the Campaign or the acceptance or use of any gift. 8. General Conditions Avex Designs reserves the right to modify or cancel the Campaign at any time. Any disputes arising from the Campaign will be resolved under the laws of the State of New York and will be subject to the exclusive jurisdiction of the courts of New York. By participating in the Campaign, participants agree to abide by these Terms and any decisions made by Avex Designs, which are final and binding in all respects.
